Definitions
Customer
"Customer" or "You" or "Your" refers to you, as a customer of the Services. A customer is someone who accesses or uses the Services for the purpose of sharing, displaying, hosting, publishing, transacting, or uploading information or views or pictures and includes other persons jointly participating in using the Services including without limitation a user having access to 'Diagnostic centre business page' to manage claimed business listings or otherwise.
Content
"Content" will include (but is not limited to) reviews, images, photos, audio, video, location data, nearby places, and all other forms of information or data. "Your content" or "Customer Content" means content that you upload, share or transmit to, through or in connection with the Services, such as likes, ratings, reviews, images, photos, messages, chat communication, profile information, or any other materials that you publicly display or displayed in your account profile. "Mytesto.in Content" means content that Mytesto.in creates and make available in connection with the Services including, but not limited to, visual interfaces, interactive features, graphics, design, compilation, computer code, products, software, aggregate ratings, reports and other usage-related data in connection with activities associated with your account and all other elements and components of the Services excluding Your Content and Third Party Content. "Third Party Content" means content that comes from parties other than Mytesto.in or its Customers, such as Diagnostic centre Partners and is available on the Services.
Diagnostic centre(s)
"Diagnostic centre" means the Diagnostic centres / Pathology labs /scan centre / Hospitals / sample Collection centre listed on Mytesto.in Platform.
Use of the Content
Mytesto.in is an online platform that allows customers to schedule lab tests from any lab our partner technician collect their blood, urine, stool or swab samples and deliver them to the appropriate diagnostic centre(s). When a customer creates a blood / urine / any sample collection appointment for test using the platform, an experienced technician will travel to the customer's location at the scheduled time to perform the procedure if required. Mytesto.in ensures that all Technician have the necessary training and equipment to provide professional services. The platform can also be used for radiological diagnosis, such as X-rays, MRIs, CT-scans, and doctor consultations with qualified medical practitioners and healthcare professionals
Changes to Terms or Services
Mytesto.in has the authority to modify on the Terms whenever it deems necessary. If this happens,
Mytesto.in is not obligated to notify you, whether you are a registered user or not, of any changes made to the Terms of Use. The updated version of the Terms of Use will be made available on the website, and your use of the website and services is subject to the most current version of the Terms of Use at the time of use. It is your responsibility to regularly check the website's homepage to view the most current Terms of Use. If you continue to use the website after changes to the Terms of Use have been made, your use constitutes your acceptance of those changes. Mytesto.in agrees to deliver merchandise or services only at locations specified in the Order Confirmation Form. Mytesto.in is not liable for delivering any merchandise or services purchased for delivery outside of India.

Clinical & Third Party Disclaimer
Mytesto.in does not offer medical advice, diagnosis, treatment, or any clinical decisions, recommendations, or judgments. The Services and Content provided are solely for facilitation purposes and are not intended to replace the competent analysis and professional judgment of healthcare professionals.
As a facilitation service, Mytesto.in assumes no responsibility for the accuracy of any test reports, diagnosis, or consultation provided by medical professionals or diagnostic centres. The Services are not intended for use in emergency situations, and individuals should call gov help line number in the event of an emergency. If urgent care is needed, individuals should contact their healthcare provider or a government medical facility by phone, in-person, or visit an urgent care center.
Third-party partners, such as Direct Sale Agents and Chemist partners, offer or telemarket Mytesto.in services. In such cases, the information disseminated may differ from the original content and is disclaimed. Eligibility to use the services
To use Mytesto.in's services, you must be at least 18 years old and able to enter into a legally binding agreement with the company, and must not be prohibited from using the services under any applicable laws. These services are currently limited to the cities of India and you must ensure that any tests are scheduled and conducted only in Indian operational cities.
When creating an account with Mytesto.in, you must provide accurate and complete information and keep it up-to-date. You are responsible for all activities that occur under your account, even if you are unaware of them. Please make sure to enter your correct details, including your first and last name, mobile number, email ID, and address, as all communication and reports are connected to this information. If you are a registered user, you must keep your account access information and password confidential, and you will be responsible for any use of your account, authorized or not. If you suspect any unauthorized use of your account, you must notify Mytesto.in immediately. Although Mytesto.in is not responsible for any losses caused by unauthorized use of your account, you may be held liable for any losses incurred by Mytesto.in or other parties due to such unauthorized use.
Customers will receive a reference number/booking ID at the time of booking request and confirmation via SMS /or email for sample collection or test at the chosen time,30 minutes prior to the scheduled time slot.
Customers must present the reference number and a valid government ID to initiate the home sample collection process.
Mytesto.in offers home collection slots from 06:00 a.m. to 08:00 p.m. on all days except Sunday. The working hours of the diagnostic centre(s) selected by the customer, and should be considered final.
The booking ID for a specific time slot is only valid during the prescribed date and time.
Customers can cancel a booking for a chosen time slot at any time before the acceptance by our diagnostic partner.
Customers must fill the Test Request Form (TRF) digitally or manually during sample collection, authorizing the sharing of personal information with the diagnostic centre(s) for certain tests.
Final confirmation of bookings for pathology test, Radiological diagnosis (e.g. X-ray, MRI, CT-Scan, etc.) or Doctor Consultations is subject to availability from the third-party Diagnostic centre.
All prices listed on the Mytesto.in Platform are provided by the Diagnostic centre Partner at the time of publication on the Mytesto.in Platform and have been placed as received from the Diagnostic centre Partner. While we take great care to keep them up to date, the final price charged to you by the Diagnostic centre Partner may change at the time of test. In the event of a conflict between price on the Mytesto.in Platform and price charged by the Diagnostic centre Partner, the price charged by the Diagnostic centre Partner shall be deemed to be the correct price.
Test reports or consultations are provided by the diagnostic centre(s), diagnostic centres, or doctor consultants on their respective letterhead, signed by their doctor or healthcare professional chosen by the customer, who remains responsible for the report's accuracy.
Mytesto.in will provide test reports digitally, or sentvia email, or accessible on their website. Reports can also be delivered electronically in various formats such as WhatsApp.
Customers authorize Mytesto.in to store the report on its portal and use any data in the report for relevant offers or recommendations for tests, but not make this data available to third parties except for affiliated Diagnostic centre(s) without customer consent, except in anonymized form.
Mytesto.in shall not be liable for any acts or omissions on part of the Diagnostic centre Partner/Store(s) including deficiency in service, wrong sample collection of test / report mismatch, quality, incorrect pricing, deficient quantity, time taken to prepare or deliver the reports, etc.
The Diagnostic centre Partner(s)/Store(s) shall be solely responsible for any warranty /guarantee / accuracy of test or report or Products sold to the Customer and in no event shall be the responsibility of Mytesto.in.
Special circumstances.
- The customer agrees and gives consent to Mytesto.in to perform a recollection of the sample free of charge in case the collected sample is haemolysed. The individual should be willing to undergo the recollection voluntarily.
- The customer agrees and gives consent to bear the additional cost in case repeat samples are required for certain tests based on the results. This means that the patient has to bear the cost of additional re-runs at different machines for recollected samples.
- The customer agrees and gives consent that while availing Radiological diagnosis or Doctor Consultations at various diagnostic centres, they shall be subject to the rules and regulations prescribed by such Diagnostic center(s). Mytesto.in or its affiliates will not be held responsible for any loss, damage, nuisance or mishap that may be sustained by the customer.
- Mytesto.in is not involved in providing any healthcare or medical advice or diagnosis, and hence is not responsible for any interactions between the customer and the diagnostic centres, doctor or healthcare professional. The customer understands and agrees that Mytesto.in will not be liable for any customer interactions, issues associated with diagnostic centres, doctors or healthcare professionals, the ability or intent of diagnostic centres, doctors or healthcare professionals in fulfilling their obligations towards customers, any wrong medication or quality of treatment being given, any medical negligence on the part of the diagnostic centres, doctors or healthcare professionals, inappropriate treatment, or similar difficulties or any type of inconvenience suffered by the customer due to a failure on the part of the diagnostic centres, doctors or healthcare professionals to provide agreed services, any misconduct or inappropriate behaviour by the diagnostic centres, doctors or healthcare professionals or their staff, and cancellation or no-show by the diagnostic centres, doctors or healthcare professionals, rescheduling of booked appointments, or any variation in the fees charged.
Text Messages
By providing your mobile phone number to Mytesto.in, either online or via text message, in order to use the Services, you agree to receive communications from Mytesto.in, and you explicitly authorize Mytesto.in to send text messages to your phone.
Restrictions on use
You agree not to do any of the following:
- You are not allowed to use, display, copy, reproduce, mirror or frame any part of the Services, including any element, name, trademark, logo, design, or form without Mytesto.in's express written permission;
- You are not allowed to attempt to decipher, decompile, disassemble or reverse engineer any software used to provide the Services;
- You are not allowed to attempt to probe, scan or test the security of any Mytesto.in system or network, or breach any security or authentication measures;
- You are not allowed to impersonate or falsely represent your affiliation with any person or entity;
- You are not allowed to violate any applicable laws or regulations;
- You are not allowed to encourage or assist any other person to engage in any of the aforementioned activities.
Payments/Modes/Refunds
Mytesto.in charges a fee for using their Services, and the specific fees are listed on their website. Payments can be made online, in cash, or through a Point of Sales Machine. If a customer books a test through the call centre, they can make a payment in cash or through a Point of Sales Machine. By making a payment, the customer authorizes Mytesto.in or their third-party payment processor to charge them for the transaction. Mytesto.in may request additional information related to the transaction, such as credit card details, billing address, and email address. The customer must have the legal right to use the payment method they provide. By initiating a transaction, the customer authorizes Mytesto.in to provide their payment information to third parties for the purpose of completing the transaction and charging their payment method. The customer may be required to provide additional information to verify their identity. Any cashback earned by the customer is credited to their Mytesto.in online wallet and can be used to book future tests. However, any unused cashback amount expires after three months of being credited to the online wallet. Cashback is only credited when a sample is collected, not when it is booked.
Promotional Offers and Schemes
From time to time, we may introduce different promotional offers and schemes on our website, and we reserve the right to discontinue them at any time. If a customer claims any benefits under such promotional offers and schemes, we will assess their claim according to the current policy at our discretion. If the customer initiates a claim, it may take up to 5 to 7 working days to process, and we may request additional documents as per the current policy requirements
Accuracy and Integrity of Information
Mytesto.in strives to maintain the accuracy and integrity of its Platform, but cannot guarantee that it is completely free from errors, inaccuracies, or unauthorized alterations made by third parties. Any inaccuracies found on the Platform can be reported to Mytesto.in for correction, and Mytesto.in may make changes or updates to the information without notice. Mytesto.in is not responsible for any information or Content posted by unaffiliated third parties on the Platform, and shall not be liable for any damages or losses arising from such information or Content.
Third Party Content and Links
The Services might have hyperlinks to third-party websites or resources. - Mytesto.in will not be responsible for any indirect, incidental, special, exemplary, or consequential damages, or damages for lost profits, lost revenues, lost savings, lost business opportunities, loss of data or goodwill, service interruption, computer damage, or system failure or the cost of substitute services of any kind arising out of or in connection with these terms or the use of or inability to use the services or content, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, even if Mytesto.in or any other party has been informed of the possibility of such damages. However, if a limited remedy mentioned in these terms fails to fulfil its essential purpose, the above limitation may not apply to you in some jurisdictions.
- In no event will Mytesto.in's total liability arising out of or in connection with these terms or the use of or inability to use the services or content exceed the amounts you have paid to Mytesto.in for use of the services or content, or Indian Rupees One Hundred Only (Rs. 100/-), if you have not had any payment obligations to Mytesto.in, as applicable.

Governing Law, Dispute Resolution and Jurisdiction
These Terms will be governed by the laws of India, and any disputes that arise between you and Mytesto.in will be resolved through arbitration by a Sole Arbitrator according to the Indian Arbitration and Conciliation Act of 1996 (as amended), with the venue being in Mumbai MH. The courts located in Mumbai will have exclusive jurisdiction over any disputes, and you and Mytesto.in both waive any objection to jurisdiction and venue in those courts
